§ 157. General provisions.

  • A.

    If the temporary use is on property owned by an entity other than the applicant, the applicant must present a notarized letter from the owner granting permission for use of the property.

    B.

    The following types of tent or outdoor sales shall be exempt from the provisions of this ordinance provided that:

    1.

    Merchandise for sale occupies a permanent, outdoor display area used in conjunction with a permanent business.

    2.

    Merchandise is located in the a temporary display area which does not occupy required parking spaces, driveway aisles or required landscaping areas, and customers must enter a permanent business on the same lot to make a purchase.

    C.

    The Prattville Fire Marshall, Building Inspector and Electrical Inspector shall inspect all uses listed under Section VI, A, B, C, D, E and F before occupancy.

    D.

    Temporary uses, except religious tent meetings and the seasonal sale of farm produce, shall provide temporary sanitary facilities. Approval of such facilities by the Autauga County or Elmore County Health Department must be presented with the application for permit.

    E.

    All permanent or temporary lighting for the temporary use shall require an electrical permit and inspection.

    F.

    The applicant shall provide public parking for the patrons of the temporary use. It shall be the responsibility of the applicant to guide patrons to the approved parking and to prevent unlawful parking.

    G.

    Any traffic control specifically required by the Prattville Police Department, as a condition of permit approval, shall be responsibility of the applicant.

    H.

    The site shall be cleared of all debris by the expiration of the permit. Any temporary structures shall be removed within seven (7) days of the expiration of the permit, however, an exception may be grant by the City Planner for produce sales structures. To insure that the site is cleared of all debris during and after the close of the temporary use, a cash bond for no less than $25 nor more than $5,000 shall be posted with City Planner. Instead of a bond, the applicant may present a signed contract with a waste disposal company. Such contract shall be included with the permit application.

    I.

    Serving of alcoholic beverages shall not be permitted without a permit from the City Council of the City of Prattville.
