§ 156. Permitted temporary uses.

  • The following temporary uses are permitted subject to the following criteria.

    A.

    Carnival or circus.

    1.

    Maximum length of zoning permit shall be fifteen (15) days.

    2.

    No structure or equipment shall be permitted within five hundred (500) feet of any property whose current use is residential.

    3.

    Signs shall be permitted as follows:

    a)

    Total area of all signage shall not exceed one hundred (100) square feet.

    b)

    All signs shall have a minimum setback of at least twenty (20) feet.

    c)

    No more than one freestanding sign, as defined by the sign ordinance, shall be permitted.

    4.

    The hours of operation shall be limited to between 10 a.m. and 10 p.m.

    B.

    Christmas Tree Sales.

    1.

    Permitted in FAR districts, as well as, Business districts.

    2.

    Maximum length of zoning permit for display and sales shall be forty-five (45) days.

    3.

    Signs shall only be permitted as follows:

    a)

    Total area of all signage shall not exceed one hundred (100) square feet.

    b)

    All signs shall have a minimum setback of at least twenty (20) feet.

    c)

    No more than one freestanding sign, as defined in the sign ordinance, shall be permitted.

    C.

    Contractor's office and construction equipment sheds.

    1.

    Permitted in any district where use is incidental to construction project on the same property.

    2.

    Maximum length of permit shall be one (1) year.

    3.

    Office or shed shall be removed no more than five (5) days after the completion of the construction.

    4.

    Signs are permitted in conjunction with construction project as specified in the sign ordinance.

    D.

    Events of Public Interest.

    1.

    Permitted events: outdoor concerts, auctions, athletic events, street fairs and associated concessions, and other similar events.

    2.

    Permitted in all business districts and property owned by the City of Prattville or the Autauga [or Elmore] County Commission

    3.

    Signs shall be permitted as follows:

    a)

    Directional signs, information signs or signs advertising individual vendors are allowed without a separate permit.

    b)

    Total area of all signs advertising a street fair and posted at the entrance shall not exceed two hundred (200) square feet, with no one sign shall exceeding one hundred (100) square feet. Total area of all signs for all other events of public interest shall not exceed one hundred (100) square feet.

    c)

    No more than one (1) freestanding sign shall be permitted.

    d)

    All signs shall be at least twenty (20) feet from all lot lines.

    E.

    Public fundraising events by non-profit organizations.

    1.

    Permitted only in B districts, unless activity is located in conjunction with a legal use granted on appeal to the Board of Zoning Adjustment.

    2.

    Permitted events: car washes, bake sales, fruit sales, and other such activities used by a church, non-profit organization or charitable organization to raise tax exempt funds.

    3.

    No activities or related signs or advertising shall be located in the public right-of-way.

    F.

    Real estate sales office.

    1.

    Permitted in any district when used in conjunction with a subdivision, residential or commercial, approved in accordance with Prattville Subdivision Regulations. The office may not contain any sleeping or cooking accommodations. A model home may serve as a temporary office, but may not be occupied as a residential structure while being used as an office.

    2.

    Permits may be issued for a maximum period of one (1) year or until all lots in the subdivision are developed; which ever expires first.

    3.

    Only real estate signs, as permitted by the sign ordinance, may be displayed in conjunction with the office.

    G.

    Religious tent meeting.

    1.

    Permitted in FAR and business districts. Permitted in Residential districts as use on appeal to the Board of Zoning Adjustment.

    2.

    Maximum length of permit shall be fifteen (15) days.

    3.

    Signs shall only be permitted as follows:

    a)

    Total area of all signage shall not exceed one hundred (100) square feet.

    b)

    All signs shall have a minimum setback of at least twenty (20) feet.

    c)

    No more than one freestanding sign, as defined in the sign ordinance, shall be permitted.

    H.

    Seasonal sale of farm produce.

    1.

    Permitted in Business and FAR districts.

    2.

    One six (6) month permit may be issued during each twelve month period.

    3.

    Sales areas, including produce stands, vehicles used as stands, and sheds, shall encompass no more than two hundred (200) square feet. Sales areas shall be set back a minimum distance of twenty (20) feet from the nearest property line. Entrances and exits shall be at least fifty (50) feet from the nearest intersection, measured from the intersection of rights of way. This shall not apply to driveways previously approved by the City of Prattville.

    4.

    Signs shall only be permitted as follows:

    a)

    Total area of all signage shall not exceed twenty (20) square feet.

    b)

    No more than one freestanding sign, as defined in Article 12 of the Zoning Ordinance of the City of Prattville, shall be permitted.
